In order to begin a divorce one of the spousal parties must file a complaint with the Superior Court. An agreement is incorporated into the judgment that is made in lieu of trial. In a trial the decisions would be made solely at the discretion of the judge. There are alternatives to litigation such as:
- Mediation: a method of dispute resolution that involves a third party mediator that helps to resolve disputes but makes no decisions regarding them. The spousal parties are responsible for all agreements made
- Collaborative Divorce: a collaborative divorce utilizes collaborative law. This is similar to mediation in that it in no way involves litigation but instead of a neutral attorney mediator, each spouse has an attorney that protects his or her own interests. Even so, this method of divorce is usually far more amicable than litigation.
- Litigation: the judge may decide the agreements made or agreements may be negotiated during the litigation process.
